CONTEST RULES:
Eligibility- Entry purchaser must be 21 years or older. All federal, state and local laws and regulations apply. Offer void where prohibited by law. The Executive Committee of the Foundation (Executive Committee) reserves the right to reject any entry forms submitted with a check that is refused by a bank for any reason or a credit card number that is incomplete, inaccurate or made on an account that is rejected by the credit card holder’s financial institution. The responsibility for providing adequate funds in connection with the entry form is entirely that of the potential purchaser, and all decisions in this area and on the raffle in general will be made by the Executive Committee. All defective entry forms will immediately be disqualified by the Foundation, and the individuals and/or entities that submitted the entry forms will be notified as soon as practical that the entry form has been rejected. The Foundation assumes no responsibility for lost, late, misdirected or non-delivered mail. Employees and the immediate family of employees of Meritage Corporation are not eligible to win any prizes. Drawings- Only 20,000 entries will be sold with a three-pack of entries being sold for $250 each and single entries being sold for $100 each. Draw dates are: Grand Opening Early Bird Draw- a minimum of three prizes will be awarded on the last Sunday of the grand opening event at the home, which is expected to occur at the beginning of January 2006. To be eligible, entries must be received by the Foundation office by 11:59 p.m. the Thursday immediately before the draw. Suns Fan Early Bird Draw- February 4, 2006 during the Suns game. To be eligible, entrants must give a special code at the time of purchase of the entry identifying them as an eligible participant and the Foundation office must receive the entry with the special code by 11:59 p.m. on January 31, 2006. Three-pack Early Bird Draw- March 3, 2006. To be eligible, entrants must have purchased a three-pack of entries and the Foundation office must receive the entries by 11:59 p.m. February 28, 2006. Car Giveaway - April 21, 2006. To be eligible, entries must be received by the Foundation office by 11:59pm on April 17, 2006. Draw for the Finalists- May 6, 2006. To be eligible, entries must be received by the Foundation office by 11:59 p.m. May 2, 2006. Final Draw- May 12, 2006. Only the three finalists are eligible. The rules for the Final Draw will be established by the Executive Committee. Those rules will be disclosed at the time the three entrants are notified they are finalists. The finalists must be present at the Final Draw unless the Executive Committee waives this requirement for good cause. Each out-of-state finalist will receive two round-trip airline tickets from any point within the continental United States to Phoenix, Arizona, with arrival the day before the final drawing. The Executive Committee of the Foundation will select the air carrier. An airline ticket will not be awarded to any finalist who resides in Arizona. Any out-of-state finalists will each receive one night’s stay at a hotel in Phoenix for the evening prior to the final drawing. The Executive Committee of the Foundation will select the hotel(s). In the event all 20,000 entries are sold before May 2, 2006, the Foundation reserves the right to set an earlier date for all draws. The chances of winning will be determined by the number of entries sold. The selection of winning entries is under the supervision of the Foundation and Henry & Horne.
Prizes- The Grand Opening Early Bird Draw will be for a minimum of three prizes. The Suns Fan Draw will be for a road trip with the Phoenix Suns designated by the Suns. The Three-pack Early Bird Draw will be for a trip for two to Loreto Bay, Baja, Mexico with three nights accommodations and airfare. The Draw for the Finalists will be to select three finalists to participate in the Final Draw. The Final Draw will be for the home and two other prizes. Each of the finalists is eligible to win only one prize at the Final Draw. The estimated value of the home disclosed in the raffle brochure and ads as furnished is $750,000. The value for the home is based upon the selling price for comparable models in the Meritage Homes at Valley Vista subdivision as of June 2005. The value of the furnishings, interior decorations and landscaping has been established by the businesses that donated them. There can be no guarantee that the eventual winner will be able to sell the home as furnished for $750,000, nor can there be any guarantee that the Internal Revenue Service (IRS) or the Arizona Department of Revenue, or its counterpart in another jurisdiction, will accept the value of any prizes for purposes of determining any income tax that may be due by the winners. No prize is valued at less than $100.00 MSRP. All prizes, including the home, will be as delivered. There will be no exchange or modifications to any of the prizes. The Foundation is not providing any guarantee or warranty associated with any of the prizes. Any warranties or guarantees on the home are provided by Meritage Homes and by the donors of the other prizes. Notification of Winners- All winners will be notified in writing by the Foundation of the requisite procedure to claim the prize. The winner of the home shall take title to the home within 60 days of the final drawing. The Executive Committee shall have the discretion of extending this deadline if the winner can demonstrate good cause why he or she is not able to take title within this 60-day period. If the winner is unable to take possession of the home, the Executive Committee shall have the exclusive authority to decide what to do with the home. In the event a winning entry has more than one name, the Foundation will award the prize to the first name listed on the entry. The Foundation is not responsible for resolving any disputes that may arise among the different individuals and/or entities named on the entry. Taxes and IRS Rules- All winners will be responsible for paying all taxes, fees, assessments, title and registration fees, and like charges, including but not limited to any homeowners’ association dues for the home. Under applicable laws, tax withholdings on prizes valued at greater than $5,000 must be remitted to the Foundation upon award and distribution of the prize, and the Foundation will remit those taxes to the appropriate authorities. The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar drawings for valuable prizes are not gifts and, therefore, do not qualify as deductible charitable contributions. No prize winners will have the option of accepting a cash equivalent. Waiver/Limitations of Liability- By entering this raffle, entrants accept and agree to be bound by all these rules, limitations and restrictions, and by the decisions of the Foundation and Henry & Horne. Entrants further accept and agree that their names and/or likenesses may be disclosed to and used by the media and may otherwise be used by the Foundation for publicity purposes and in a list of prize winners to be published in select media and websites. Other rules and regulations may apply. The Foundation’s interpretation and application of the rules and regulations shall be final. By entering this raffle, entrants release the Foundation, Phoenix Children’s Hospital, and their respective parent companies, affiliates, partners, subsidiaries, agents, representatives, sponsors, service agencies, and independent contractors, and each of their respective directors, officers, employees, and agents from any and all liability caused by or resulting from the use or possession of any prize awarded or caused by or resulting from participation in the raffle or any related promotion.
